New Automated External Defibrillator laws

Two new laws, effective January 1, 2006, require that health studios acquire Automated External Defibrillators (AED's) and that schools acquiring an AED have notification and training requirements.

Every health studio in the state beginning July 1, 2007 is required to acquire an Automated External Defibrillator. Studios will also be photo: Automated External Defibrillatorrequired to have available and train employees to respond in the event the AED is needed should someone collapse with sudden cardiac arrest.

There will be liability protection that will cover both employees and the studios. Studios will have to follow specified procedures including assuring that;

  • The AED is maintained and regularly tested

  • The person using the AED activates the EMS system as soon as possible and reports the use to the local EMS agency

  • Employees receive training to assure that a trained employee is available at all times

  • Health studios have a written plan describing emergency procedures

The law, formally known as Assembly Bill 1507, is now found in Chapter 431 of the Statutes of 2005. It added Section 104113 to the California Health and Safety Code. Questions regarding the new statute can be addressed to Orange County EMS (714) 834-3500.

AB 254 in Chapter 111 of the Statutes of 2005 changed the existing law regarding AED's to include requirements if an AED is placed in a public or private K-12 school.

The bill requires the principal to ensure that administrators and staff annually receive a brochure describing the proper use of the AED. It also ensures that similar information is posted next to each AED. Information needs to be distributed at least annually.

The principal must also designate trained employees who shall be available to respond to emergencies during normal operating hours, which includes any school-sponsored activity occurring on school grounds. The law does not require schools to obtain an AED.
